Terms of use

By using Okat the user agrees to be bound by its Terms of Use. Continued use of Okat implies continued acceptance of the Terms. The Terms of Use may be updated from time to time without prior notice.

Copyright

The user acknowledges that Okat contains proprietary intellectual property and copyright information. Copying, republishing or in any other way reproducing content from Okat in any form without permission is prohibited.

The organisations that use Okat and publish content on Okat (hereinafter ‘Organisations’) remain the sole copyright holders of their own content and are responsible for the content published under their name. By publishing on Okat the Organisations confirm that the content is their own and/or that it does not violate the rights of third parties and pertinent laws.

Disclaimer

Okat is provided on an ‘as is’ and ‘as available’ basis and without guarantees, warranties or support of any kind. The use of Okat is at the user’s own risk and Baltic Human Rights Society (BHRS), Okat’s founding and managing organisation (hereinafter ‘Management’), and the Organisations disclaim any liability for losses or damages incurred by users or third parties. 

Okat’s Management and Organisations cannot guarantee that Okat and its content is accurate, up-to-date, error-free, or accessible. They reserve the right to add, update, or remove any content at any time and without prior notice.

The content on Okat may contain external links to websites, documents, and social media platforms in order to provide the user with additional content. Okat’s Management and Organisations are not responsible in any way for external links and content and this Terms of Use does not apply to external links and content.

The content published on Okat represents the views of the respective Organisation only, not of Okat’s Management, other Organisations, nor of Okat’s partners, and financial supporters.

Privacy

This section of the Terms of Use explains and regulates the collection, storage, and use of personal data collected on Okat. 

Okat is hosted on servers within the EU and its data collection is thus subject to EU law and regulations. Okat does not track its users, neither by its Management and Organisations nor through third parties services. Okat does not use Google Analytics, nor is connected with social media platforms. 

Solely for technical purposes, the following data about the user’s device is collected, stored and used: ip address, device model, screen size, internet browser, and geographic location. This information used to:

  • Provide the best possible visual and technical experience for the user’s device model, screen size, and internet browser
  • Collect statistics on the use and experience of its users
  • Remember the user’s cookies settings
  • Perform the user’s queries
  • Provide data security and prevent or disclose fraud or other offences

Okat also stores any information, including non-personal and personal data, collected by the Organisations, as submitted by and with consent of the user. This data is controlled by the Organisations, not Okat’s Management.

No personal data is disclosed to third parties, neither by the Organisations nor Okat’s Management, except in cases with the explicitly stated consent of the user or where the disclosure is requested by judicial authorities acting under the law. In the event a user wishes to review, update or delete the personal data provided to an Organisation via Okat, the user must contact that Organisation using the contract details provided on the Contact page of the test, survey or form that user used.

Okat uses SSL encryption to secure data communication. Okat’s Management and Organisations cannot not guarantee that the information transmitted over the internet is safe or that such transmissions will not be subject to delay, disturbance, interception, or error.

BHRS acts as the data controller, which takes care of the lawful processing and protection of personal data in accordance with the pertinent laws and regulations.

Cookies

Okat uses short-term (session) and long-term (persistent) cookies. Session cookies track the user’s action during a single browsing session, but they do not remain on user’s device afterwards. Persistent cookies are used to authenticate the user and save their preferences, these remain on the user’s device between sessions.

Okat also uses third party cookies for the purpose of ensuring secure and comfortable operation of the website, as well as for the purposes of generation of internal, non-personal statistics in order to analyse and learn more about the use of Okat and the experience of its users. These cookies are mandatory for the full operation of the website.

Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Latvia.
